Terms of sale

1- Acceptance of Terms.

The customer acknowledges, at the time of the order, the conditions of sale that figure herein and accept them without reservation. The present general conditions of sale govern the contractual relationship between the company Coses de Muntanya, S.L., hereafter CM, and customer, both parties accepting them without reserve. These terms and conditions shall prevail over all other conditions contained in any other document, unless prior express consent in writing. All orders placed on Coses de Muntanya, S.L. Company, are for personal use of customers, clients or recipients of the product avoiding any reselling of the product.

2 - Price.

CM reserves the right to change prices at any time, but products will be billed based on the rates in effect at the time of the entry of the order (subject to availability).

The products remain the property of CM until full payment. The prices of products are indicated in euros, including Spanish taxes and VAT, but do not include shipping costs. Ordering over the Internet, the total price indicated in the order confirmation will include the price of the products, handling, packaging and storage of goods and, finally, shipping costs. In the case of delivery to a country other than Spain, the recipient of the order shall be deemed the importer of the products concerned. For shipments outside the European Union, all taxes (national VAT, customs or import) shall be responsibility of the recipient to collect the package once you arrive at your destination. 3 - Orders

The system will automatically record the order. CM confirmed the acceptance of the order to the email address provided by the customer. CM reserves the right to cancel any order from a customer with whom there is a dispute concerning the payment of a previous order.

4 - Availability

In case of temporary unavailability of any product, CM reserves a period of an additional week for processing orders. In case of permanent unavailability of product after placing an order, the buyer will be notified by email or by phone, communicating the current lack of product. The buyer will have a week (except weekends and holidays) to request the cancellation or change the order. 5 - Delivery.

The items will be shipped to the delivery address provided by the buyer during the ordering process. In case of error in the delivery address, the seller declines all responsibility for any failure in the delivery. The possible delays do not entitle the buyer to claim damages. Deliveries to EU countries will be made by mail or by courier. Deliveries outside the EU will be made by international postal services. In case of defects, the buyer is entitled to return on the basis of the conditions laid down in this document.

7 - Safe Payment.

Payments are totally safe to be controlled directly by the customer, via bank transfer as the payment via PayPal through. 8 - Return and refund.

A - The buyer has 7 days from the delivery of the order (in accordance with the relevant articles on the basis of the law 7/1996 of 15 January 1996, of retail trade) to return any product.

This right applies to defective products or do not comply with your request. However, if the returned items are incomplete, damaged or soiled by the customer, or are not delivered with their tags intact in its original packaging (if present), will not be allowed to return by CM.

CM does not accept packages return expenses against reimbursement for shipping costs.

10 - Intellectual Property.

All texts, comments, illustrations and images reproduced on http://everesttrailrace.com/etr_Store reserve copyright, as well as intellectual property, regulated by the code of intellectual property, being necessary the authorization of CM for any non-personal use.

11- Liability.

The products are in accordance with Spanish legislation. CM is not responsible in the case of breach of the law of the country in which the goods are supplied. It is up to the buyer to check with local authorities the possibilities of importation or use of the products that make up your order. The images and texts illustrating the products are not contractual. As a result, CM is not responsible in case of error. 12 - Claims.

CM is not responsible for damages of any kind, whether tangible or intangible, either the result from a malfunction or misuse of the products sold. In all cases CM is not responsible for the breach of the rules and laws in force in the host country, the liability is always limited to the value of the product in question, the value at the date of sale and without the possibility of appeal to the brand or the manufacturer of the product.

13 - Personal information.
